During the band's formation, Jacob Hacker tried out as
their bassist using a noise music routine he had created under the
pseudonym "the NORD." Though Hacker was not accepted into the band, The
Agony Scene made him their opening act and took him on as a roadie.
Between 2003-2004, The Agony Scene was living with Hacker prior to their
being signed to Roadrunner, until Hacker was evicted due to non-payment of
rent and over $1000 worth of damages damages incurred to his apartment
from he and Agony Scene's parties (it is alleged that these parties
involved narcotics, binge drinking, and homosexual group sex).
In 2004, Brian Hodges, Jacob Hacker, and Warren Darr were arrested in
Broken Arrow, Oklahoma for breaking into cars in downtown Tulsa, in
order to steal stereos, and then selling the stereos to pawn shops in
Broken Arrow using false identification.
Hodges plead guilty to two counts of burglary and five counts of
concealing stolen property. He was sentenced to three years in prison, but
given a suspended sentence on the condition that he pay $750, plus
damages, and complete 80 hours of community service, and serve three years
probation. Hacker plead guilty to two counts of burglary and five counts
of possessing stolen property, and was sentenced to five years
probation. Warren Darr plead guilty to two counts of burglary and five counts
of concealing stolen property and was sentenced to three years
probation.

Darkest Red, an album poised to crack the contents of each and every
spectator’s skull all over the floor. "We are really, really proud of
this album," declares drummer (and co-founding member) Brent Masters.
"When we wrote The Darkest Red, we weren’t taking much of an influence from
anybody. We were just writing parts that felt good to us .“We put a lot
into this record because we were trying to break away from being The
Agony Scene that everyone knew."
